The revised inheritance law comes into force on January 1, 2023

The focus of the revision is the reduction of the statutory compulsory portions and the elimination of the spouse’s entitlement to a compulsory portion during divorce proceedings. According to this, the testator will have more freedom of disposal and scope for change in the future. According to current law, descendants are entitled to three quarters of the statutory portion of the inheritance as a compulsory portion. Only half of it should be new. With the revision, the compulsory portion of the parents is no longer applicable. With the reduction in the compulsory portion, the testator can, for example, also favor the actual life partner or the stepchildren more. With the new law, Swiss inheritance law is supposed to meet today’s demands and modern ways of life such as blended families and cohabitation.
